Terms of Service

1. Agreement to Terms

By accessing or using the BookFlow AI platform ("Service"), operated by BookFlow AI ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

These Terms apply to all visitors, users, and paying subscribers. We may update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

2. Description of Service

BookFlow AI is a software-as-a-service (SaaS) platform that uses artificial intelligence to make outbound phone calls to leads, handle conversations, and book appointments on your calendar. The Service includes a dashboard, call recordings, analytics, calendar integrations, and billing management.

3. Account Registration

  • You must provide accurate, complete information when creating an account.
  • You are responsible for maintaining the security of your login credentials.
  • You must be at least 18 years old to use the Service.
  • One person or entity may not maintain more than one free-trial account.
  • You are responsible for all activity that occurs under your account, whether or not you authorized it.

4. Subscriptions & Billing

BookFlow AI offers usage-based subscription plans:

  • Starter — $129/month (250 AI minutes included)
  • Growth — $349/month (600 AI minutes included)
  • Scale — $799/month (1,800 AI minutes included)

Minutes beyond your plan's allocation are billed at the per-minute overage rate shown on your plan. All payments are processed securely through Paddle. Prices are in USD and do not include applicable taxes.

5. Free Trial

We offer a 14-day free trial for new accounts. No credit card is required to start. At the end of the trial, you must select a paid plan to continue using the Service. If you do not subscribe, your account will be paused and data retained for 30 days before deletion.

6. Cancellation & Refunds

You may cancel your subscription at any time through the dashboard billing page or by contacting support. Upon cancellation, your subscription remains active until the end of the current billing cycle. Please see our Refund Policy for details on eligibility and the refund process.

7. Acceptable Use

You agree not to use the Service to:

  • Make calls that violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM, or any applicable telemarketing laws.
  • Call numbers on the National Do Not Call Registry without prior consent.
  • Engage in fraud, harassment, or any illegal activity.
  • Upload or transmit malicious software, spam, or unauthorized bulk communications.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Misrepresent the AI caller as a human when legally required to disclose AI usage.

Violation of this section may result in immediate account termination without refund.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data (lead lists, call recordings, transcripts). We do not sell your data to third parties. You are responsible for ensuring that your use of lead data complies with applicable privacy regulations (GDPR, CCPA, etc.).

9. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is the intellectual property of BookFlow AI and is protected by copyright, trademark, and other laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

10. Third-Party Services

BookFlow AI integrates with a limited number of third-party infrastructure and service providers to deliver its platform. The current list is published at bookflow.ai/subprocessors. BookFlow AI is not responsible for the availability, accuracy, or policies of these providers. Your use of integrated services is subject to their respective terms.

11. Service Availability & Modifications

We strive to maintain high uptime but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. Planned maintenance windows will be communicated via email or in-app notifications.

12. Limitation of Liability

To the maximum extent permitted by law, BookFlow AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid to BookFlow AI in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, that AI calls will result in booked appointments, or that the AI voice will be indistinguishable from a human in all circumstances.

14. Indemnification

You agree to indemnify and hold harmless BookFlow AI, its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
